Ombar is owned and operated by Mood Foods Limited (a United Kingdom company).

YOUR STATUTORY RIGHTS ARE NOT AFFECTED BY OUR TERMS AND CONDITIONS.
1. About These Terms
By placing an order through our website, you agree to be bound by these Terms & Conditions.
These Terms apply to the sale of goods only. Separate policies apply to delivery, privacy and competitions (linked below).
We may update these Terms from time to time. The version in force at the time of your order will apply.
2. Orders & Contract Formation
All orders are subject to acceptance and availability.
After placing an order, you will receive an acknowledgement email. This does not mean your order has been accepted. A contract is formed only when we dispatch your goods.
We reserve the right to refuse or cancel an order where reasonably necessary, including where we suspect:
- Fraudulent activity
- Misuse of promotions
- Breach of these Terms
If we cancel your order after payment has been taken, you will receive a full refund.
3. Pricing & Payment
All prices are shown in GBP and include VAT where applicable.
We take reasonable care to ensure pricing is accurate. However, errors may occasionally occur. If we discover a pricing error in your order, we will inform you and give you the option to reconfirm at the correct price or cancel for a full refund.
We reserve the right to change prices at any time prior to an order being placed.
Payments are processed securely via our payment providers. We do not store full card details.
Charges will appear as “Mood Foods Limited”.
4. Delivery
Delivery times are estimates and not guaranteed. Full details can be found in our Delivery Policy.
We are not responsible for delays caused by:
- Courier disruption
- Incorrect delivery details provided by you
- Circumstances outside our reasonable control
Risk in the goods passes to you upon delivery.

5. Cancellation (Cooling-Off Rights)
If you are purchasing as a consumer, you have the right to cancel your order within 14 days of receiving your goods under the Consumer Contracts Regulations 2013.
To exercise this right, email orders@ombar.co.uk.
You must return the goods unopened and in their original condition. Return postage costs are your responsibility unless the goods are faulty.
We will issue a refund within 14 days of receiving the returned goods (or evidence that they have been sent back).
Please note:
Due to their perishable nature, food products are exempt from cancellation rights once delivery has been completed, unless they are faulty, damaged or not as described. We may, at our discretion, offer refunds or replacements on a case-by-case basis.
6. Returns, Faults & Delivery Responsibility
We take great care to ensure our chocolate arrives in perfect condition.
If your product is faulty, damaged or incorrect, please contact us within 3 days of receipt and include:
- Product name
- Expiry date
- Photographs (if possible)
If a fault is confirmed, we will offer a replacement or refund.
We are unable to offer refunds for products that are not to your personal taste.
Delivery & Liability
Many deliveries are fulfilled by third-party couriers and may be left in a safe place or on a doorstep where requested or deemed appropriate by the courier. Once delivery has been confirmed by the courier, responsibility for the goods passes to you.
We are not liable for loss, theft or damage after a delivery has been successfully completed. However, if you believe there has been an issue with delivery, please contact us and we will review on a case-by-case basis.
We reserve the right to refuse replacements or refunds where we reasonably suspect misuse of our delivery or returns policy.
This does not affect your statutory rights under the Consumer Rights Act 2015.
7. Product Information & Allergens
We take reasonable care to ensure product descriptions and ingredient information are accurate. However, recipes and manufacturing processes may change.
Customers with allergies should always check the label on the product received before consumption.
Our products are produced in facilities that handle nuts and other allergens.
If you have specific dietary concerns, please contact us before ordering.
8. Storage & Heat Sensitivity
Chocolate is sensitive to heat. During warmer months, minor cosmetic changes (such as bloom) may occur but do not affect safety or quality.
We are not responsible for heat damage where delivery has been completed successfully.
We recommend storing chocolate in a cool, dry place away from direct sunlight.
9. Limitation of Liability
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any matter for which liability cannot legally be excluded
Subject to the above, we shall not be liable for:
- Indirect or consequential losses
- Loss of profits, business or data
- Losses not reasonably foreseeable
Our total liability shall not exceed the value of the goods purchased.
10. Intellectual Property
All content on this website, including logos, packaging designs, text and imagery, is the property of Mood Foods Limited or its licensors.
You may not reproduce or use any content without written permission.
“Ombar” is a registered trademark of Mood Foods Limited.
11. Medical Disclaimer
Our products are foods and are not intended to diagnose, treat, cure or prevent any disease.
If you have medical concerns or dietary restrictions, please seek advice from a qualified health professional before consumption.
12. Privacy & Marketing
We process personal data in accordance with our Privacy Policy.
If you subscribe to our marketing communications, you can unsubscribe at any time by clicking the unsubscribe link in the footer of our emails.
Please note: our marketing emails are sent from unmonitored inboxes and replies to these emails will not be received. If you need to contact us, please email orders@ombar.co.uk.
We do not sell your personal data to third parties.
13. Competitions & Promotions
Competitions are subject to separate promotional terms which will be provided at the time of entry.
Unless otherwise stated:
- Entry is open to UK residents aged 18+
- Winners will be selected fairly and notified directly
- Prizes are non-transferable and no cash alternatives are offered
- Promotions are not sponsored by or affiliated with Instagram, Facebook or other platforms

14. Force Majeure
We are not liable for failure to perform obligations due to events beyond our reasonable control, including but not limited to supply chain disruption, transport delays, strikes, or natural events.
15. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
